Workers Compensation
Workers' compensation is insurance that provides cash benefits and/or medical care for workers who are injured or become ill as a direct result of their job. If you are injured while at work below is some helpful information and steps to ensure your claim runs smoothly.
- Seek medical attention if needed. Tell your doctor it is a work-related injury, DO NOT use your personal health insurance.
- Report your injury to your supervisor.
- Complete the Accident Report, and call the Accident Reporting System (ARS) 1-888-800-0029, they will take the report of your injury quickly and confidentially.
Human Resources will need certain information to report to the State Insurance Fund in support of your claim. This can be provided on the Accident Report or directly to the Leaves Manager in HR.
- If you seek medical attention at any time, HR needs the name of the doctor, and the location where treatment was provided.
- Any days you do not work due to the injury.
- If you have been directed not to work due to injury.
- A statement from the treating physician is required stating when and why cannot work.
It could take 1-3 weeks before you receive a claim number from the State Insurance Fund. If you are out of work for more than 5 days, you will be removed from our payroll and paid the statutory benefit by the State Insurance Fund until such time as you can return to work.
While receiving Workers' Compensation from the State Insurance Fund, your benefits do not change for the length of your disability to a maximum of 12 months. You will accrue seniority, accruals, and retirement credit. While receiving pay from the State Insurance Fund, your health insurance continues through the college. However, you will be responsible for paying your portion of the premiums either direct billed from NYS or extra payroll deductions upon your return to work.
When you are ready to return to work your physician must complete the Return-to-Work form. This form needs to be to HR 24-48 hours prior to your listed return to work date. DO NOT return to work until told to do so by Human Resources.

All classified staff must serve a 5-7 day waiting period before being placed on Workers' Compensation Leave. You have the option of using accrued leave credits or being placed on leave without pay. Each day used should be labeled "WC Waiting Period" in the notes box on your time off request.
If you are medically excused from work for more than 7 days, then compensation becomes payable on the 8th day. If you are out for more than 14 calendar days, then the waiting period becomes payable retroactively.

PEF Contract- Article 13If you have not returned to work after the five (5) day waiting period you will be placed on Workers' Compensation Leave and paid the statutory benefit from the State Insurance Fund. Benefits are based on the average weekly wage (AWW) earned by the employee during the 52-week period immediately prior to the accident. The maximum weekly benefit rate is equal to two-thirds of the AWW in NYS, subject to the degree of disability.
Medical benefits are paid by the insurance carrier (SIF).

Employees necessarily absent from duty because of an on the job injury or disease who are allowed leave from their position for the duration necessitated by such injury shall
- Leave with pay no charge to accruals not to exceed six months then
- Can draw accrued leave credits; and then
- Can be allowed to use sick leave @ 1/2 pay unless their is good and sufficient reason they can't.

Benefits are based on the average weekly wage (AWW) earned by the employee during the 52-week period immediately prior to the accident. The maximum weekly benefit rate is equal to two-thirds of the AWW in NYS, subject to the degree of disability.
Medical benefits are paid by the insurance carrier (SIF) regardless of which choice is made.

Employees can take the Workers' Compensation Leave statutory benefit from the State Insurance Fund. Benefits are based on the average weekly wage (AWW) earned by the employee during the 52-week period immediately prior to the accident. The maximum weekly benefit rate is equal to two-thirds of the AWW in NYS, subject to the degree of disability.
OR
Employees may charge their accruals to remain in a full paid status during leave. This option may result in a refund of the employees accruals on a pro-rated basis pending reimbursement by State Insurance Fund and subsequent Workers' Compensation Board (WCB) Notice of Decision.
Medical benefits are paid by the insurance carrier (SIF) regardless of which choice is made.
